A Tax, Not A Tax

As the Sunday morning news talk shows got warmed up, the topic at hand this week was the SCOTUS ruling on Obamacare.

With that ruling, the justices, 7 to 2, called the mandate unconstitutional under the commerce clause, but by a 5-4 ruling stuck the mandate under the taxation power and ruled it constitutional. Systematically changing the law. 
The wording in HR3590, the bill that became law, was re-written from HR3200 to remove the word "tax penalty" and restated it as penalty, removing the word tax, so as not to appear to be raising taxes on anyone making under their $250K threshold.

Chief Justice Roberts was the deciding factor in Obamacare mandate and ruled it constitutional under the powers of congress to lay and collect taxes and the penalty IS a tax.

Now the Republicans are having at Obama for raising taxes on anyone making less then $250K, as he promised he would not do, during the run up to the 2008 election.

The left and Democrats are hailing Roberts as a hero that saved a law that takes control over a private sector of our economy (socialism). This is the same Justice Roberts who ruled in the Citizen United case that Unions and Corporation have a right to freedom of speech and with that ruling it infuriated the liberals-progressives. But now he's their hero and they are loving it. Go figure.

On Fox News today, the Whitehouse Chief of Staff, Jack Lew, continued to regurgitate the Obama Whitehouse that the "penalty" was not a tax, even though the supreme court ruled it as such.
Chris Wallace quickly dissented.


Mr Lew, Tax= A sum of money demanded by a government for its support or for specific facilities or services, levied upon incomes, property, sales, etc. and to demand a tax from a person, business, etc. to demand a tax in consideration of the possession or occurrence of (income, goods, sales, etc.), usually in proportion to the value of money involved.

The Whitehouse now thinks it can change the meaning of "Tax" But, that doesn't surprise this blogger!

Citizens United v. Fed Election Commission


The landmark decision by the United States Supreme court that the McCain-Feingold act violated free speech was un-presidented ruling that infuriate liberals to no end.

It allows Corporations, millionaires and Unions to donate money, sometimes millions of it to help elect their Candidate.
In his 2010 State of the Union address, Obama said of the decision:

"Last week, the Supreme Court reversed a century of law to open the floodgates for special interests, including foreign corporations, to spend without limit in our elections. Well I don't think American elections should be bankrolled by America's most powerful interests, or worse, by foreign entities."

Now we do know that foreign corporations cannot spend without limits. That was upheld.
But now comes a twist to the Presidents remarks on special interest, and I am sure Obama is not saying the same thing today.

A report out by the Associated Press yesterday said Multimillionaire George Soros' contributed $1 million to the advocacy group America Votes and another $1 million pledge to American Bridge 21st Century, an outside "super" political committee supportive of Obama's campaign. 

"As he has in the past, George is focusing his political giving in 2012 on grassroots organizing and holding conservatives accountable for the flawed policies they promote," Soros adviser Michael Vachon said

Flawed policies? Does Vachon mean Capitalism?

"Thanks to investments by progressive leaders like Mr. Soros, we have been able to build a cutting-edge organization that we will continue to build upon in order to keep providing effective and efficient services to the progressive movement," said David Brock, American Bridge's founder.

Oh the Hypocrisy of the left!

So far, GOP super PACs have outraised their Democratic counterparts by tens of millions of dollars.  

So if a liberal/progressive ever rants about McCain-Feingold act and the SCOTUS decision of it, you can slam them with this. They've got no complaints any longer.

Pelosi and Congressional Dems- Amend the 1st

Nancy Pelosi and congressional Democrats are proposing an idea to amend the 1st Amendment because they are so enraged about the US Supreme courts ruling on Citizens United v. Federal Election Commission.

 
 “We have a clear agenda in this regard: Disclose, reform the system reducing the roll of money in campaigns, and amend the Constitution to rid it of this ability for special interests to use secret, unlimited, huge amounts of money flowing to campaigns,” Pelosi said at her Thursday press briefing.


“I think one of the presenters at a Democratic forum on amending the Constitution yesterday said that the Supreme Court had unleashed a predator that was oozing slime into the political system, and that, indeed, is not an exaggeration,”


“Our Founders had an idea. It was called democracy. It said elections are determined by the people, the voice and the vote of the people, not by the bankrolls of the privileged few. This Supreme Court decision flies in the face of our Founders’ vision and we want to reverse it.”

First off, Ms Pelosi, our Founders had an idea called the "Republic" for which your leadership in the House, during the 111th congress, failed MISERABLY!
Second, we still have an election determined by the people. People who might also be a part of a Corporation, but individually empower to cast a vote.



Regardless of how a Campaign is funded and the message that that funding promotes, a corporation has no power to vote as a whole and Citizens United v. Federal Election Commission didn't change that.


The audacity of the progressives in our nation to want to fundamentally change the 'Bill of Right' is quite certain another attack ON THE CONSTITUTION!
